Matthew Delude recently had a significant victory in the first case he argued in the New Hampshire Supreme Court. The petitioners in the proceeding below had brought suit against over 100 homeowners, including Matthew’s clients, seeking to eliminate a declaration on common land the petitioners possessed legal title to. In the proceedings below, Matthew successfully sought and obtained summary judgment on behalf of his clients and the other respondents on all counts, and the trial court ruled the declaration was enforceable and that the respondents were entitled to transfer of the common land to an association they would form. The petitioners appealed that order and the NH Supreme Court affirmed the order in all respects with a 5-0 decision in favor of Matthew’s clients.
