Douglas Wolinsky recently attended a two-day trademark workshop sponsored by the American Intellectual Property Law Association. The sessions covered current procedures at the Patent and Trademark Office, where trademarks are registered, and practices before the Trademark Trial and Appeals Board, which hears appeals from PTO decisions. It also focused on oppositions to registration of trademarks and cancellations of existing registrations. Considerable time was spent on enforcement of trademark rights, covering the prosecution and defense of infringement claims, including cease and desist campaigns, and litigation in the United States District Courts.
