Ryan will present an overview of the new Chapter 11 “Subchapter V” Bankruptcy as part of a panel of experienced practitioners and trustees. Effective February 2020, Subchapter V provides a new streamlined process for small businesses to reorganize under Chapter 11 in less time and with reduced complexity, cost, and administrative requirements. However, with only limited Subchapter V cases on the record, Subchapter V also presents numerous procedural and substantive questions and Subchapter V’s agility may present new challenges for creditors.
